ESSAY AND MPT QUESTIONS AND SELECTED ANSWERS

The Board of Bar Examiners has now posted on our website answers to the essay questions and MPT items from the bar examination. The MPT is copyrighted so we cannot supply that item to you; however, you can purchase it from the National Conference of Bar Examiners at www.ncbex.org if you wish. The essay answers were selected by the Bar Examiner who wrote the question and graded the answers. The MPT answers were selected by the examiner who graded the MPT answers. These are "good" answers but are not always perfect answers. They are among the best that were written on this question. They are being sent to you in an effort to demonstrate the variety of answers that may result in a high score. Some Examiners selected three answers and some selected fewer. The handwritten answers were typed as submitted, except that minor corrections in spelling and punctuation were made for ease of reading.

Applicants were given forty-five minutes to answer each of the essay questions. Instructions for writing the essay answer are as follows:

  1. Assume that the questions arise under the laws of Georgia, unless otherwise indicated.
  2. Each answer should show: an understanding of the facts; a recognition of the issues involved; the principles of law applicable; and the reasoning by which you arrived at your conclusions. The value of an answer depends not so much upon the correctness of the conclusions as upon the presence and quality of the elements above-mentioned.
  3. Clearness and conciseness will count but make your answers complete. Do not volunteer irrelevant or immaterial information.
  4. Demonstrate not merely your memory, but your ability to think and analyze the issues.
  5. Read each question carefully and understand it before answering.
